mclaren escaped any penalty. yea! spot-on. the team didnt benefit nor use the ferrari docs so it makes sense.
no offense to ferrari fans

Yeah, it's ok to get confidential documents via questionible means. That's ok. It's ok to spy and steal if you don't use the info. Yeah, it's ok. NOT!!!!

Whether you are a Ferrari fan or not, Mclaren got away with it. They optained info they should not have had. It's wrong. I don't care what anyone says.

i say that because i read some stuff. in legal terms yes it is considered mclaren got the info coz coughlan was a high senior staff. case in point, stepney is also considered high senior staff in ferrari.
thus in legal terms it is assumed that stepney is the same as ferrari giving the docs themselves to mclaren (coughlan)
thus from what i read, in a legal standpoint, yes mclaren got the docs BUT was given by ferrari themselves. doesnt hold water to give out penalty if they didnt use it.

the issue bout mclaren knowing the ferrari car and telling the fia that particular issue with fia to 'limit' ferrari development of that side... well some said that extra feature on the bodywork is/was not within the fia bodywork regulations or whatever, = cheating. thus telling fia they cheated or wasnt following guidelines in certain aspects is not necessarily 'limiting' development to begin with.

nehow, most thought the docs that they (coughlan and stepney) held were in fact saved to be used at honda whom they approached.

so what do i think of all this?
i really dont care. i wanna see some action on the track. its been exciting so far and a helluva season.

just like i didnt cause too much ruckus when i thought the fia was unjustly punishing alonso for holding up massa last year. or how some tracks were resurfaced to suit ferrari bridgestone combo last year, or how the stewards killed the championship chances of my hero at the time montoya in indianopolis some years ago.
i still remember em, but i dont care too much after.
its a sport, period. i watch it for my enjoyment of the racing.

They were convicted of violating the sporting code, and then did not get punished for it. Again, they got away with it.

yep as i said where i read, it is essentially the same as ferrari giving the docs to mclaren and telling the fia that mclaren has it.
yes by legal definition they had it and thus violated the sporting code coz they had it, and yes it is also considered that ferrari gave the docs themselves to mclaren. thats what i read.
i also read further it said its the same if say ferrari gave the same docs to honda or toyota and then went to tell the fia honda and toyota had possession of their docs. kinda entrapment.
thats legal definition for you.
another way is, u have a car. ur friend borrows your car without your permission and lends it to his new gf whom u never met or know. she runs a red light and got caught speeding with a speed trap camera.
should the ticket that comes later be paid by you or ur buddys gf whom u do not know? case in point, should u be responsible for her violations?
or to make it more viable, your car was stolen and the thief jumped all red lights etc.

in the end, mclaren said they did not know until ferrari notified them nor did they benefit from it.
the issue of the bodywork not following regulations. coughlan could have just 'told' dennis to look at that particular area.
as i understand it, industrial espionage is rampant and has been around awhile in f1. most common way is to use photographs and videos, just like ferrari wings flexes for less downforce in recent times.
they could have used photographs to make that deduction and assumption.

in any case, they got it covered so far to extricate themselves from penalty. guilty by association, and not knowingly (as they said).
so... uaaargghh... this has gotten on long enuff, see example scenario above and if the logic makes sense to you.
if i cant change ur mind, no amount of debate will change it.

lets just enjoy the sport eh?
